PCCYFS has been sounding the alarm regarding liability insurance and its impact on Pennsylvania’s children’s services providers since 2020. Through provider surveys, white papers, publications, one-pagers, meetings, workgroups, and other initiatives, we have slowly been spreading the word about how scarcities in liability insurance are impacting children’s services providers. Over the years, we have seen this issue spread beyond just Pennsylvania and have connected with a variety of other states to talk about shared concerns, priorities, and potential solutions. And as we continued to amplify provider concerns, we are now seeing action happening at the national level.
Pennsylvania and PCCYFS, in particular, is seen as a leader in advancing solutions to the children’s services liability insurance crisis. We are one of a few states where the legislature has taken legislative action to support this issue. PCCYFS’ long-time advocacy has helped bring this issue to the forefront on the national scale.

Meeting with ACF
On March 13, PCCYFS President/CEO Terry Clark joined the Administration for Children and Families (ACF) as one of the few state associations in the room to participate in a roundtable discussion on how the federal government can support this issue.
Terry shared about the various initiatives and legislative solutions PCCYFS is advancing and spoke to the diversity in state child welfare structures and what potential solutions may work for most states. From Pennsylvania, he was also joined by State Representative Kate Klunk (R-Hanover), who had previously sponsored an insurance-related bill for PCCYFS.

NAIC
The National Association of Insurance Commissioners has created a working group focused on this issue and Pennsylvania Insurance Commissioner, Michael Humphreys, is also a participating member of this group. They had their first meeting yesterday and PCCYFS was invited to join this meeting. PCCYFS has been meeting regularly with state officials, including the Department of Human Services, the Governor’s Office, and the Insurance Department to help keep all Administration officials informed of the potential impacts of this looming crisis.
National Child and Family Services Liability Insurance Working GRoup
There are also a number of organizations participating in a National Child and Family Services Liability Insurance Working Group. PCCYFS has supported this initiative and weighed-in on various publications and surveys. Read more about the work happening in this group here.
